  TERMS OF BUSINESS
 

 

 Catering Staff 


1) These Terms and Conditions of Business are between WARBURTONS Agency (hereinafter called the "AGENCY") and the Employer Client (hereinafter called the "CLIENT") and are deemed to beaccepted by the client by virtue of an interview of the engagement (which term includes employment or use, whether under a contract of service or for services) of an applicant introduced by the Agency.


2) The client agrees: a) to notify the agency immediately an engagement is accepted and b) to pay the fee of the agency within 10 days of receipt of the account.

 

3) The fee payable to the Agency by the Client for the introduction of an applicant is calculated as set out in the accompanying scale of fees. Any weekly charge includes all salary, payments and other taxable emoluments payable to or receivable by the applicant for services rendered to or on behalf of the client. VATwill be charged in addition to the fee. 


4) Should the relevant engagement terminate before the expiry of 3 weeks, you are entitled to a refund less a charge under our temporary scale for each week our applicant has been with you, provided that the client notifies the Agency in writing within 7 days of the termination and has paid the Agency's fee within 10 days of the date of invo
ice. Furthermore our full fee remains due and/or no refund will be given if the offer of employment is cancelled or the employment is terminated due to any reason whatsoever,other than the unsuitabillity
 of our applicant. WE WILL REPLACE AT NO EXTRA CHARGE FOR A FURTHER 5 WEEKS MAKING A 2 MONTH GUARANTEE PERIOD upto a maximum of 2 replacements should the employment  terminate outside the refund period again it should be stressed  that we need  written  notice and it is only on the basis that our applicant is unsuitable.

 

4a) Should the Client or any subsidiary or associated Company/person of the Client subsequently re-engage the applicant within the period of three calendar months from the date of termination a full fee in accordance with paragraph 3 above becomes payable.

 

5) Introductions are confidential.The passing on of an introduction to another employer which results in an engagement renders the Client liable to payment of the Agency's fee, in full. 

 

6) An introduction fee is calculated in accordance with Paragraph 3 of those terms will be charged in relation to any applicant engaged as a consequence or of resulting from an introduction by or through the Agency, even though the introduction may be made indirectly.

 

7) The Agency endeavours to ensure the suitability of an applicant introduced to the client. In each case references etc will be taken up and checked, but owing to distances involved, not every applicant can be personally interviewed by us. The Client shall notwithstanding satisfy him/herself as to the suitability of any applicant and shall take up references provided by any applicant and/or the Agency before engaging such applicant. The Client shall be responsible for obtaining work and other permits, for the arrangement of any medical examinations and/or investigations into the medical history of any applicant, if required and satisfy any medical and other requirements or qualifications required by law. 

 

8) The Agency shall not be liable under any circumstances for any loss of expense suffered or incurred by the Client arising from or in any way connected with the Agency seeking an applicant for the Client or the introduction by the Agency to the client of any applicant or the engagement of any applicant by the Client. It must be understood that on your acceptance of an applicant, you are the employer and not the Agency. WARBURTONS ACTS ONLY AS AN AGENCY OF INTRODUCTION.

 

9) No variation can be made to these terms without the written consent of a partner of the Agency. 

 

10) Late cancellation: should a chef/cook be cancelled without 48 hours notice, we reserve the right to charge a full fee of a full week plus VAT.

FULL AND PART TIME PLACEMENTS:- 

 


Four weeks salary + VAT for payment within our normal terms. You are able to reduce the gross amount (not inc VAT) by half a week if you agree to pay within ten days.


TEMPORARY STAFF:- 

 

£50.00 + VAT (per person) for the first week and and for subsequent weeks. PLEASE NOTE: Under this arrangement we are not running the payroll, the temporary person must be paid through your books under the PAYE scheme, as with your other staff. We must advise you not to accept self employed status without direct authority from the Inland Revenue, or without a UTR number from the HMRC


EMERGENCY SERVICES (STAFF
  FOR  DINNER   PARTIES ,    FUNCT I ONS    WEDD I NGS    ETC):- 

 

Waiting and Bar Staff £8.00 per person
Head Waiting and Bar Staff £I0.00 per person
Kitchen staff/washing up staff £6.00 per person
Cooks and Chefs £25.00 per person



We have a minimum charge of £50.00 + VAT
